STATVEL Properties

Mr. Velar is also affiliated with several property-holding entities operating under variations of the name “Statvel.” He is cited as a “manager” for Statvel One, LLC and his company, Flamingo South Development Corp., is a listed manager for Statvel Three, LLC. Mr. Velar’s business partner, Henry Pino, is also a member of the Statvel companies. According to corporate records, both companies operate out of the M C Velar Construction headquarters address.

In June 2006, Statvel Three, LLC acquired a set of commercial properties (seven parcels in total) located at the intersection of SW 37th Ave. and SW 23rd St. in Miami, Florida for $13.25 million.

Statvel Three took out a $9,937,500 mortgage with Regions Bank to purchase the properties. A year later, in September 2007, Regions agreed to modify the mortgage and provided an additional advance of $400,000 to Statvel. Next, in November 2008 Statvel negotiated a second mortgage modification, wherein Regions allowed for an extension of the loan’s maturity date.

LOAN DEFAULT

On February 1, 2010 Regions Bank filed a lawsuit in federal court against Manuel Velar, Cheryl Velar, and Henry Pino, alleging that Statvel Three, LLC defaulted on their loan agreement having failed to make monthly payments in December 2009 and January 2010. According to the Regions complaint, Statvel owes over $7.3 million on the loan. To date, the suit is pending. Learn more in the “Litigation” section below.

Worker Fatality

On November 1, 2006 a worker at a Miami, Florida building construction project fell 210 feet to his death. M.C. Velar Construction was a contractor on the project, providing concrete forming used at the site. OSHA cited M.C. Velar, along with three other companies working on the project, for a total of 16 violations with proposed penalties of $59,000.

OSHA’s Ft. Lauderdale Area Director stated that “These companies placed the lives of employees at risk by not providing proper fall protection equipment and training.”

Loans & Finances

M C Velar has registered several Uniform Commercial Code (UCC) filings with different lenders in the state of Florida.

On August 3, 2005, M C Velar took out a loan with Union Planters Bank citing as collateral “all of the debtor’s personal property…and all proceeds thereof”, suggesting Union Planters was M C Velar’s primary lender. Due to a merger, Union Planters Bank later became part of the Regions Financial Corporation.

September 27, 2005: M C Velar filed another UCC with CIT Group/Equipment Financing Inc. The UCC filing lists one (1) Pettibone Model 6036 Extendo lift serial number 4030 as collateral. This agreement is set to expire September 27, 2010.

In 2007, M C Velar Construction Corp took out two (2) loans with Regions Financial. The UCCs, dated 10/02/2007 and 10/08/2007, were filed only 6 days apart. The first UCC cites as collateral all money, funds, credit and deposits with Regions, while the second cites “all accounts of the debtor” as collateral. Then on February 8, 2010, M C Velar filed for a continuation on the 2005 loan with Union Planters.

Liens

Manuel C. Velar has had multiple liens placed on him either directly or through one of his business ventures.

  • On October 10, 1990, the City of Hialeah placed a lien on Mr. Velar, as owner of 4101 East 11th Ave. The city claimed that Velar did “not have the required spray room for a paint and body shop”.
  • In 1994, the Federal Government filed two (2) liens, dated 4/7/1994 and 7/15/1994, against Mr. Velar for unpaid taxes and penalties. In total, the two liens added up to $36,918.10. These liens were released in 1995 and 1996, respectively.
  • June 19, 1996: Miami-Dade County placed a lien on Mr. Velar, along with Alexander Velar and Benjamin Torres, as owners of 1166 SW 131 Place Circle North, Miami, 33186 for the amount of $5,535.00. On January 16, 1998, this lien was paid and released.
  • On July 8, 1997, Miami-Dade County again placed two (2) liens on Mr. Velar along with Alexander Velar and Benjamin Torres for $2,100 total. Neither lien was released until August 10, 2005 (lien 97R302739, lien 97R302740).
  • In 2009, Latite Roofing & Sheet Metal, LLC made a claim against Manuel and Cheryl Velar for $18,678.75 in unpaid bills related to roofing work performed on 606 Flamingo Dr, Ft. Lauderdale.
  • Another complaint was filed against Mr. and Mrs. Velar on February 11, 2010 by Ray Mannion Co for unpaid bills totaling $4,665.00. Ray Mannion Co. claimed the money was the remaining fee for installing an air conditioning system at 606 Flamingo Dr, Ft. Lauderdale.

According to Plaintiff Regions Bank’s complaint, the bank provided $9.9 million mortgage loan to Statvel Three, LLC in June 2006. Defendants Manuel C. Velar and Henry Pino “unconditionally guaranteed Statvel’s obligations.” Subsequently, the mortgage was modified on two occasions, and both times Mr. Velar and Mr. Pino allegedly renewed and confirmed their guarantees for the loan. Regions further claims that Statvel defaulted on the loan agreement by failing to make monthly payments for December 2009 and January 2010. The outstanding balance for the loan was $7,312,574.16.
