General Crane HQ Property Cited
for Violations by City Inspectors

The City of Pompano Beach, Florida recently levied a series of fines against Steven Retterath for failure to fix property code violations at General Crane USA’s headquarters.
A Pompano Beach property code enforcement inspector conducted an initial site visit of the five parcels of land that comprise the General Crane yard on July 29, 2009. During the inspection, the official found at least twenty (20) separate violations at the properties.
Among the violations cited was that the owner, Steven Retterath, did not meet the requirements for an outdoor storage facility on his property. In another case a parcel was not authorized to have an outdoor storage facility. Also, each of the parcels was cited for stacking outdoor storage too high above the boundary wall or hedge. Following the July inspection a public hearing concerning the violations was held in front of the City of Pompano Beach Special Magistrate on October 28, 2009. General Crane USA’s in-house counsel represented the respondent, Steven Retterath. The next day the city magistrate issued an order directing Mr. Retterath to bring his properties into compliance with the city code by February 5, 2010, or he would face fines of $250.00 per violation per day commencing on the 5th.
On February 9, 2010 the same code enforcement officer returned to the General Crane headquarters for a follow-up inspection. The inspector identified eleven (11) violations still not in compliance with the city code.
As a result, two weeks later, February 25, the Pompano Beach magistrate issued five separate fines – one for each parcel of land – against Mr. Retterath. From February 5 onward the magistrate imposed fines totaling $2,750.00 per day for the eleven (11) code violations. Mr. Retterath had twenty days to request a hearing to contest the ruling and thirty days to file an appeal. It is unclear at this time the total amount of fines levied against Mr. Retterath.

On March 30, 2010 General Crane filed a motion in its ongoing Chapter 11 bankruptcy case for a 90-day extension to determine whether the company wanted to assume or reject the property leases for all of its crane yards.
