Summary of Complaint: The plaintiff, A.V.I. Contractors, Inc. alleged a “breach of contract” against the defendant, Gulfstream Crane, LLC, stemming from a written agreement in July 2006 in which Gulfstream rented a tower crane to A.V.I. for a construction project.  A.V.I. claimed that Gulfstream violated the terms of the agreement by failing to deliver the crane to the project site on the date guaranteed, overcharging for services rendered, failing to accept charges for damage to the project, overbilling, and charging A.V.I. for crane dismantlement when in fact Gulfstream had left the crane standing on site.  A.V.I. asked for injunctive relief requiring Gulfstream to dismantle the crane due to potential safety hazards posed to the worksite.  A.V.I. also alleged that Gulfstream filed a “fraudulent lien,” exaggerating the claim “to include amounts for work not performed.”  Lastly, A.V.I. alleged “tortuous interference” against Gulfstream for its refusal to dismantle the crane and consequently hindering completion of the project. Gulfstream Crane denies allegations. The case was dismissed in July 2008 following satisfaction of the lien.
