Summary of Complaint: Cause of action arose out of an incident in August 2004 when plaintiff (Rinkus), then an employee of General Crane USA, was performing construction work on a condominium unit in Hollywood, FL. The plaintiff alleges that he was forced to engage in high-altitude crane activities in “dangerous” wind conditions. The plaintiff was instructed by his supervisors to utilize a tag line, which was attached to the crane cable to control a swinging load while erecting the crane. The plaintiff was allegedly required to be position under the crane load as it was lowered to the ground. During this process the tag line became wrapped around an exposed structural component on the unfinished building. The tag line released in the heavy wind causing the load to swing down on top of the plaintiff. The impact rendered the plaintiff a paraplegic. Gulfstream Crane denies allegations.
