Summary of Complaint: The complaint alleges that since August 2006 Republic Crane Service agreed to be bound to a collective bargaining agreement with the International Union of Operating Engineers, Local Union No. 12. Pursuant to the agreement, Republic Crane Service was obliged to contribute monies to employee benefit Trusts created pursuant to written agreements between IUOE Local 12 and various employer associations in the construction industry. The plaintiffs allege that Republic Crane is delinquent $209,668.41 in benefit payments to the Trusts. In addition, Republic Crane owes $20,966.84 in liquidated damages.

On October 5, 2009 Republic Crane Service LLC agreed to pay the full amount due plus interest to various Operating Engineer Local 12 trusts. Payment must be made by March 2010.
